{"id":49896,"date":"2025-12-15T11:54:38","date_gmt":"2025-12-15T16:54:38","guid":{"rendered":"https:\/\/smallfarms.cornell.edu\/?post_type=guide&#038;p=49896"},"modified":"2026-05-18T16:13:53","modified_gmt":"2026-05-18T20:13:53","slug":"compliance-versus-circumventing","status":"publish","type":"resources","link":"https:\/\/smallfarms.cornell.edu\/es\/recursos\/guide-to-direct-marketing-livestock-and-poultry-2\/compliance-versus-circumventing\/","title":{"rendered":"Compliance Versus Circumventing"},"content":{"rendered":"<p>The purposes of government regulations for the inspection of meat and poultry products are to:<\/p>\n<p>1) prevent the sale of adulterated, contaminated, or otherwise unsafe livestock products; 2)<br \/>\nprevent misbranding; 3) ensure the safety of consumers by establishing minimum standards for<br \/>\nthe production, slaughter, processing, and marketing of these products; and 4) create a system of<br \/>\nlicensing, inspection and labeling to trace a product back to its origin if a public health problem<br \/>\nshould arise.<\/p>\n<p>An inadvertent side effect of increased regulation and validation is that smaller processors and<br \/>\nfarmers may be disproportionately disadvantaged due to economies of scale. For example,<br \/>\nvalidation equipment is often expensive to purchase and maintain. The smaller volume of output<br \/>\nof smaller plants results in these plants incurring a greater overhead expense on a per pound<br \/>\nbasis.<\/p>\n<p>This negatively affects producers and conflicts with the stated aim of our New York agricultural<br \/>\nagencies to increase the sales of value-added farm products. However, a close study of the meat<br \/>\nstatutes reveals some exemptions and alternatives that can benefit the small farmer and processor<br \/>\nwho are marketing slaughter animals or meat products.<\/p>\n<p>It is far better to have an excellent understanding of the meat regulations and to diligently<br \/>\nstudy any changes in their interpretation rather than to focus on circumventing them and<br \/>\nrisk trafficking in illegal or unsanitary products.<\/p>\n<p>Advocates for the New York livestock industry need to build strong communication channels<br \/>\nwith meat inspectors. There is a formal review process for proposed changes in the wording of<br \/>\nstatutes. These livestock industry advocates need to rapidly apprise farmers and small processors<br \/>\nwhen such regulatory reviews are ongoing and find ways to motivate the affected parties to<br \/>\nparticipate in the process. There are no formal regulatory review procedures when the<br \/>\ninterpretation of a regulation is being changed. This is unfortunate, because even a small change<br \/>\nin interpretation can have damaging implications for farmers and processors.
